Agreement between User and www.wilseywellness.com
Welcome to www.wilseywellness.com. The www.wilseywellness.com website (the "Site") is comprised of various web pages operated by Wilsey Wellness, LLC ("WWLLC"). www.wilseywellness.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.wilseywellness.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
www.wilseywellness.com is a Therapy Site.
WWLLC provides information on individual and couples therapy to potential clients and current clients. It is a way to get in touch with a potential therapist, Dr. Kate Wilsey, who can provide video telehealth to individuals in the state of Virginia.
Privacy
Your use of www.wilseywellness.com is subject to WWLLC's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting www.wilseywellness.com or sending emails to WWLLC constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Children Under Thirteen
WWLLC does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use www.wilseywellness.com only with permission of a parent or guardian.
Cancellation/Refund Policy
Cancellations and missed appointments may be subject to a cancellation or missed appointment fee. Please discuss further with Dr. Wilsey.

www.wilseywellness.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of WWLLC, and WWLLC is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. WWLLC is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by WWLLC of the site or any association with its operators.
Certain services made available via www.wilseywellness.com are delivered by third-party sites and organizations. By using any product, service, or functionality originating from the www.wilseywellness.com domain, you hereby acknowledge and consent that WWLLC may share such information and data with any third party with whom WWLLC has a contractual relationship to provide the requested product, service, or functionality on behalf of www.wilseywellness.com users and customers.
No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use www.wilseywellness.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to WWLLC that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of WWLLC or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends, or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. WWLLC content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of WWLLC and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. International Users
The Service is controlled, operated, and administered by WWLLC from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the WWLLC Content accessed through www.wilseywellness.com in any country or in any manner prohibited by any applicable laws, restrictions, or regulations.
Indemnification
You agree to indemnify, defend, and hold harmless WWLLC, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations. WWLLC reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with WWLLC in asserting any available defenses.
Liability Disclaimer
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. WILSEY WELLNESS, LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. WILSEY WELLNESS, LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
WWLLC reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the Commonwealth of Virginia and you hereby consent to the exclusive jurisdiction and venue of courts in Virginia in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and WWLLC as a result of this agreement or use of the Site. WWLLC's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of WWLLC's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by WWLLC with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and WWLLC with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and WWLLC with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.
Changes to Terms
WWLLC reserves the right, in its sole discretion, to change the Terms under which www.wilseywellness.com is offered. The most current version of the Terms will supersede all previous versions. WWLLC encourages you to periodically review the Terms to stay informed of our updates.

Good Faith
Estimate (GFE)
Under the No Surprises Act, which took effect on January 1, 2022, health care providers must provide a Good Faith Estimate to clients or patients who do not have insurance or are not using insurance for their care. This estimate outlines the expected costs of medical items and services.
Your Right to a Good Faith Estimate
You have the right to receive a Good Faith Estimate that details the total expected cost of any non-emergency services. This may include, when applicable, related expenses such as medical tests, prescription medications, equipment, and hospital fees.
The Good Faith Estimate is based on the information available at the time it is created. It does not include unexpected or unknown costs that may arise during treatment. If additional services or complications occur, the actual cost may be higher than the estimate.
What to Do If You Receive a Higher Bill
If you receive a bill that is at least $400 more than your Good Faith Estimate, you have the right to dispute the charge.
Your Dispute Options:

Contact the health care provider or facility

Request that they update the bill to match the Good Faith Estimate.

Negotiate the bill or inquire about financial assistance.

Initiate a dispute resolution process with the U.S. Department of Health and Human Services (HHS)

The dispute process must begin within 120 calendar days (about 4 months) from the date on the original bill.

There is a $25 fee to initiate a dispute.

If the reviewing agency rules in your favor, you will only be responsible for the amount in your Good Faith Estimate.

If the agency agrees with the provider, you will be required to pay the higher amount.

Timeframes for Receiving a Good Faith Estimate
Your health care provider must provide you with a Good Faith Estimate within the following timeframes:

If your appointment is scheduled at least 3 business days in advance:
You must receive the estimate within 1 business day of scheduling. -
If your appointment is scheduled at least 10 business days in advance:
You must receive the estimate within 3 business days of scheduling. -
If you request a Good Faith Estimate (without scheduling an appointment):
You must receive it within 3 business days of your request.
If you reschedule a service or request a new estimate, an updated Good Faith Estimate must be provided within the applicable timeframes.

A Good Faith Estimate is for informational purposes only. It does not require you to make any payments or commitments.

Keep a copy of your Good Faith Estimate for your records. You may need it if you receive a higher bill.

Wilsey Wellness LLC (the “Practice”) is committed to protecting your privacy. The Practice is required by federal law to maintain the privacy of Protected Health Information (“PHI”), which is information that identifies or could be used to identify you. The Practice is required to provide you with this Notice of Privacy Practices (this “Notice”), which explains the Practice's legal duties and privacy practices and your rights regarding PHI that we collect and maintain.
YOUR RIGHTS
Your rights regarding PHI are explained below. To exercise these rights, please submit a written request to the Practice at the address noted below.
To inspect and copy PHI.

You can ask for an electronic or paper copy of PHI. The Practice may charge you a reasonable fee.

The Practice may deny your request if it believes the disclosure will endanger your life or another person's life. You may have a right to have this decision reviewed.
To amend PHI.

You can ask to correct PHI you believe is incorrect or incomplete. The Practice may require you to make your request in writing and provide a reason for the request.

The Practice may deny your request. The Practice will send a written explanation for the denial and allow you to submit a written statement of disagreement.

You can ask the Practice to contact you in a specific way. The Practice will say “yes” to all reasonable requests.
To limit what is used or shared.

You can ask the Practice not to use or share PHI for treatment, payment, or business operations. The Practice is not required to agree if it would affect your care.

If you pay for a service or health care item out-of-pocket in full, you can ask the Practice not to share PHI with your health insurer.

You can ask for the Practice not to share your PHI with family members or friends by stating the specific restriction requested and to whom you want the restriction to apply.

You can ask for a list, called an accounting, of the times your health information has been shared. You can receive one accounting every 12 months at no charge, but you may be charged a reasonable fee if you ask for one more frequently.

OUR USES AND DISCLOSURES
1. Routine Uses and Disclosures of PHI The Practice is permitted under federal law to use and disclose PHI, without your written authorization, for certain routine uses and disclosures, such as those made for treatment, payment, and the operation of our business. The Practice typically uses or shares your health information in the following ways:

Example: Your primary care doctor asks about your mental health treatment.
To run the health care operations.

The Practice can use and share PHI to run the business, improve your care, and contact you.

The Practice can use and share PHI to bill and get payment from health plans or other entities.

2. Uses and Disclosures of PHI That May Be Made Without Your Authorization or Opportunity to Object The Practice may use or disclose PHI without your authorization or an opportunity for you to object, including:
To help with public health and safety issues

Public health: To prevent the spread of disease, assist in product recalls, and report adverse reactions to medication.

Required by the Secretary of Health and Human Services: We may be required to disclose your PHI to the Secretary of Health and Human Services to investigate or determine our compliance with the requirements of the final rule on Standards for Privacy of Individually Identifiable Health Information.

Health oversight: For audits, investigations, and inspections by government agencies that oversee the health care system, government benefit programs, other government regulatory programs, and civil rights laws.

Serious threat to health or safety: To prevent a serious and imminent threat.

If it is in your best interest because you are unable to state your preference.
4. Uses and Disclosures of PHI Based Upon Your Written Authorization The Practice must obtain your written authorization to use and/or disclose PHI for the following purposes:

Marketing, sale of PHI, and psychotherapy notes.

You may revoke your authorization, at any time, by contacting the Practice in writing, using the information above. The Practice will not use or share PHI other than as described in Notice unless you give your permission in writing.
OUR RESPONSIBILITIES

The Practice is required by law to maintain the privacy and security of PHI.

The Practice is required to abide by the terms of this Notice currently in effect. Where more stringent state or federal law governs PHI, the Practice will abide by the more stringent law.

The Practice reserves the right to amend Notice. All changes are applicable to PHI collected and maintained by the Practice. Should the Practice make changes, you may obtain a revised Notice by requesting a copy from the Practice, using the information above, or by viewing a copy on the website www.wilseywellness.com.

The Practice will inform you if PHI is compromised in a breach.
